Terms & Conditions
1. Liability
We endeavour to ensure that all our clients get complete satisfaction. However, we act on behalf of various operators in
connection with the sale of travel products and, unless specified as the operator, Smashing Tours is an agent of the
operator or hotel concerned. Accordingly, there is no direct contractual relationship between you on the one hand and
us, unless we are acting as the operator. All bookings accepted by us and arrangements made are therefore subject to
the terms and conditions of the operator concerned and we normally have no direct contractual liability to you in
connection with the travel product except as may be imposed by law.
2. Payments
A non-refundable deposit is normally payable at time of booking, and the balance is payable in accordance with the t
erms and conditions of the operator concerned (which may also be at the time of booking). All payments, whether by
cheque, bank transfer or credit/debit card are made to the Smashing Tours. The only exception to this is, for
example, some airline tickets and you will be advised of this at time of booking. Your receipt/invoice is your
final account and no further reminder regarding payment will be sent. In the event that you do not pay for the
travel product within the time limits specified, we reserve the right to cancel (or not to confirm) your booking
without further notice to you. Any outstanding amount will then be dealt with in accordance with the operator’s
terms and conditions and any applicable laws.
3. Alterations/cancellations
Wherever possible, Smashing Tours will assist if you wish to make an alteration to a booking, or cancel. However,
you should be aware that there will be an administration charge and that most operators will also make a charge
if the change requested is possible which in some cases, it may not be. Operators generally reserve the right
to make changes themselves under certain circumstances which will be shown in their terms and conditions. If
Smashing Tours is acting as the operator, we reserve the right to cancel or make a material change: for any
reason whatsoever prior to the day on which payment of the balance becomes due; or for reasons of force majeure
at any time prior to departure.
4. Passports, Visas, Driving Licenses
You are responsible for ensuring that you have all the necessary valid documentation for your trip, including visas.
5. Health
Prior to travelling abroad you are advised to study the information given in the Department of Health leaflet
“Health Advice for Travellers” (available by calling 0800 555777) or check the website at www.dh.gov.uk. You
are responsible for advising us of any medical condition or disability which may affect your participation
in your travel arrangements.
6. Insurance
You must have appropriate travel insurance (which we or the operator can arrange for you). We reserve the
right not to accept bookings from clients who are not insured and accept no responsibility for clients who
do travel uninsured. All baggage and personal possessions remain (at all times and in all circumstances)
at the owner’s risk.
7. Late arrivals/delays
It is your responsibility to arrive at all the departure points at the times specified in your itinerary –
neither Smashing Tours nor the tour operator will accept responsibility for the consequences of late or
non-arrival, or for delays occasioned by any carriers.
8. Complaints
Any complaint in respect of your travel arrangements should be made at the time it arises to the
representative of the tour operator/ground agent/airline, etc. Any unresolved complaint should be
made to us in writing within six weeks of return from travel.
9. Data Protection
It may be necessary for us to request personal information from you e.g. dietary, disability, passport,
credit card. In all cases, this will be treated as confidential but may need to be passed to suppliers,
where appropriate, in order for them to fulfil their obligations to you. Please note that these suppliers
may be outside the EEC (and therefore not bound themselves by the Data Protection Act).
